For the child Crown prosecutor in you

The annual meeting of the Moose Lodge Secret Society attracts some of the leading exponents of wisdom and civilisation to the Wannabefullamojo resort beside a pristine lake in the Canadian hinterland. This highly exclusive group includes several noted McGill alumni who are particularly adept at the annual initiation rites to which unsuspecting new members are subjected. Typically, in the Society's venerable century-old tradition, members become heavily intoxicated and subject new members to acts of wanton humiliation and sadistic cruelty in order to determine their worthiness.

At the 2006 annual meeting, Bob, Joe and Terry, 3 long-standing members of the Society, learn that a former McGill colleague and now famous lawyer by the name of Paul is among the new members. They remember Paul as an intensely competitive, presumptuous, "know-it-all" student who was shamelessly sycophantic to his professors and who did not hesitate to step on his fellow students and work colleagues to achieve his career ambitions. They see the initiation rite as a long-awaited opportunity to exact revenge on him.

Bob tells Joe and Terry: "Boy, would I like to make that SOB pay a heavy price for his arrogance. I remember how he used to make fun of my purple Afro in front of the girls at the Law Games. You know it was very fashionable in those days." When they first come across Paul at the resort, he speaks to Bob mockingly, calls him a loser, taunts him about his poor grades in law school and reminds him of his failure to make partner at the law firm they used to work at together. Bob is a very insecure and depressed man and is deeply insulted. He controls his intense anger and murderous thoughts in anticipation of imminent revenge. Upon Paul's departure, the 3 of them decide that his insolence calls for serious punishment. They deliberate on various options and in a fit of rage, Bod says: "We should kill the bastard, crush him like a filthy cockroach." Joe and Terry tell Bob not to over-react, but Bob persists and urges them to figure out a way of getting rid of Paul for good. Later in the day, after consumming a significant quantity of alcohol, Joe turns to Bob and Terry and says: "You know, you were right, we should kill that bastard. He really deserves it and I know exactly how we can do it, without even getting caught." Bob says: " Well, maybe you were right. I was over-reacting. Maybe this is going too far. But you can do whatever you want. I just don't want to know about it."

Later that evening, as Joe and Terry become intensely intoxicated, they decide in Bob's absence to throw Paul into a nearby lake, knowing that he cannot swim. Terry says to Joe: "Let's throw him in the water and see what happens. Maybe he will make it to the shore. Maybe he won't. Ha, ha, ha." Joes says to Terry: "Yeah, it will be fun to see Mr. High and Mighty so vulnerable. He will have to beg us for mercy. His life will be in our hands." To avoid suspicion, they take Paul together with another new member by the name of Frank, blindfold them but keep their hands free, and tell them that they will be subjected to an undisclosed initiation rite. They take the new members blindfolded to the lake, walk them to the end of a long pier, and throw them into deep water. Paul screams: "Help. I can't swim. Help. Where are you Frank? Help me or I will drown." Frank responds to Paul by saying: "I can't swim either. I am going to drown. Someone help us." Terry and Joe are surprised to hear that Frank cannot swim. They assumed all along that he could swim because Frank had told them earlier in the day that he takes his children swimming during the summer months.

Meanwhile, Bob hears the screaming and comes out to see what is happening. When he sees Paul thrashing in the lake, he yells in his inebriated condition: "Drown you arrogant swine. Drown. It serves you right for making fun of my bell-bottom pants at Coffeehouse. Good job Joe. Good job Terry. You guys have guts. I knew you could do it." Realizing that nobody will save him, Paul, true to his selfish character, decides to grab on to Frank and float on him to avoid drowning. He pushes Frank's head under the water and position himself on his shoulders so he can remain above the water and breath. Using Frank as a flotation device, he manages to get back to the pier without drowning. Seeing that Frank is still under water, Terry and Joe jump into the lake and place his lifeless body on the pier. They attempt to revive him without success and Frank dies shortly after. When Paul accuses them of trying to kill him, Terry and Joe respond: "This was just meant to be a joke. We wanted to see if you could make it or not. We would have rescued you if we thought you would drown. We are so sorry about Frank." Bob says to Paul: "You selfish bastard. You killed Frank. All you cared about was saving your own life. You should have been the one who died."

You are a Crown prosecutor. You have been asked to write a brief and concise memorandum for the Attorney-General to consider: (a) which substantive charges under the Criminal Code may be brought against Terry, Joe, Bob, and Paul respectively; (b) the basis for their participation in the relevant crimes; and (c) to anticipate and respond to potential defences that may be raised at trial.

quand j'ai commencé à lire, j'ai cru que ce n'était pas un cas et que Paul existait pour vrai. J'ai même cru deviner de qui il s'agissait.
